Matthew Ma is a partner at Merits & Tree. Prior to joining Merits & Tree, Mr. Ma worked at Zhong Lun Law Firm, Global Law Office, and other prestigious firms.

 

Mr. Ma has rich experience in the industry of TMT, e-commerce and pharmaceutical and healthcare. With such knowledge of industries, he is capable of solving complex legal issues for clients and safeguard their interests. Matthew regularly assists multinational companies with the legal aspects of their IP protection and commercial transactions and litigations, including representing clients in commercial dispute resolution, designing enforcement strategies for protection of their IP, providing strategic consultation on their business in China. Matthew also handles IP due diligence for various clients in both domestic and cross-border transactions. He has represented a number of Global 500 companies in solving their legal issues in China.

  • Advised state-owned enterprises in Universal Studios theme park project in Beijing. Advised client in contract drafting and negotiation related to licensing of intellectual property rights from foreign owner
  • Advised multiple domestics and foreign pharmaceutical companies in cross-border merger and acquisition, licensing transactions
  • Advised a famous U.S. basketball association in licensing transaction related to establishment of small theme park and gym in various cities
  • Advised a leading seed company in its licensing of hybrid inbreds to local breeders
  • Represented a well-known private equity fund in trademark infringement and unfair competition dispute against a copycat and obtained favorable judgment
  • Represented a large US solar cell manufacturer in its preliminary injunction petition related to trade secrets of manufacturing process of solar cells. (First PI case ever accepted by Shanghai Intellectual Property Court)
  • Represented a famous electrical company in trademark infringement and unfair competition dispute against its competitor
Dispute Resolution
  • Represented a famous Chinese cosmetics company in contract/licensing dispute against the National Basketball Association (“NBA”)
  • Represented a French cosmetics company in contract dispute against its supplier on Tmall platform, successfully responded to the injunction proposed by supplier and forced it to withdraw the case
  • Represented a Hong Kong listed PV company in its stock assignment dispute against an Inner Mongolian company for construction of a solar power station and obtained favorable arbitral award
  • Represented a top e-commerce operation company in contract dispute against brand owner, obtained favorable judgement and ensured its business model before listing of the company

  • Advised a French cosmetics company in compliance investigation of employee’s embezzlement and bribery issue
  • Advised a world-leading information and analytics provider in its employment matters including repayment of social insurance and housing fund contributions
  • Advised a foreign wire & cable manufacturer in its criminal investigation of former employee’s embezzlement, including reviewing employee’s emails, collecting evidence, communicating with PSB
